Such understanding allows us to effectively teach â€Å"other peoples’ children† Taking a Look at My School and What I See (and Don’t See) Schools and districts are influenced by social, political and economic forces not readily apparent. Underlying the visible elements of our school communities are unapparent forces that make even more impact on our students, schools and us. These invisible historical forces contribute to the sense of privilege or deprivation experienced in our schools that impacts our students, parents and us. These forces are termed as equity issues and serve as the metaphorical elephant in the room that many pretend not to see. Are there â€Å"Equity Issues† in Your School? Reaction to equity issues is dependent on one’s own experiences as a student. Different experience produced for students of different cultural groups (past present). Regardless of personal experiences, a school leader and his/her vision benefits from knowledge of historical context of access and equity issues. Two expressed values not fully realized are universal public education through High School and equitable educational opportunities (ex. Only 27 states have compulsory education requirements to age 16). Progress toward universal education is linked with advancement in equitable treatment and equal outcomes for students based on gender, race, ethnicity and ableness is also evolving. Prominent researchers have pressed the issue for equity in schools for 2 generations. Confronting the â€Å"Gaps† as a Leadership Issue Leaders faced with challenge of leading schools in ways that provide equitable opportunities irrespective of a student’s culture The mere composition of any school poses naturally challenges due to differences (culture, race, gender, socio-economic, achievement, etc. ). Leaders need to address systemic access disparities of quality educational programs, experienced funding and equitable school funding otherwise the status quo of gaps will continue. More equitable funding alone does not even things out . . . must be accompanied by a change in the way many students are educated. Important question for leaders: How do we meet the academic and social needs of students who come to school with a different set of values, beliefs, socioeconomic experiences, behaviors, language and ability? NCLB as a Leadership Tool NCLB can serve as a tool to support access and equity efforts. NCLB has made public aware of di fferential educational opportunity and achievement patterns that exist in our schools and communities. NCLB used as pretext to point out and address achievement gap issues. Such a gap is a multifaceted outcome measure of gaps in access to education. Achievement gaps differentiated by race, ethnicity, gender, class, etc. are being highlighted by the media. Definitions of Key Terms Culture: The set of practices and beliefs shared by members of a particular group that distinguish that group from other groups. Cultural Informancy: Reflects our experience of having cross cultural relationships that are authentic and trusting which allow for mutual learning and feedback leading to personal growth. Demographic Groups: Often used in schools in pace of subgroup. Dominant Culture: A culture readily visible in a classroom and school which often benefits from treatment, attention and success while others may be hidden and not apparent and not receive equitable treatment or attain equal leve ls of success.. Equity: Access to material and human resources in proportion to needs. Ethnicity: Ancestral heritage and geography, common history and to some degree physical appearance. National Origin: A designation related to a person’s country of birth and prior citizenship. Nativism: The practice of valuing the rights of citizens born in this country over those of immigrants (marginalization effort attempt of immigrants). Race: A concept developed by social scientists and misinterpreted and used by groups to characterize people by their physical features and to use those differences to justify suppression of some while promotion of others. Reflection: careful consideration of one’s behaviors, plans, values and assumptions in an effort to improve interpersonal and professional practice. Sexual Orientation: An enduring, emotional, romantic, sexual or affectional attraction to another person. It exists along a continuum and differs from sexual behavior because it refers to feelings and self-concept. Chapter 2: The Cultural Proficiency Leadership Lens Provides an overview of the tools of cultural proficiency. Such will provide one with an important lens and knowledge for action. Getting Centered Educational gaps are our issue with at least 3 arguments being important prerequisites: 1. We must acknowledge that educational gaps are historical and persistent. Although we inherited them, they cannot be ignored. The issue of academic underperformance of children of poverty and some visible minorities is not new information. 2. If gaps are to be closed, we must move forward to examine our values, behaviors, policies and practices of our schools. 3. We can make a difference when we pay attention to who students say they are and their needs before the needs of our own and that of the school system. Cultural proficiency is: †¢ A process that begins with us, not with our students or their communities †¢ A shift in thinking that moves us from viewing culture as problematic to embracing and esteeming culture. A lens through which we view our role as educators †¢ A concept comprised of a set of four interrelated tools to guide our practice. Cultural Proficiency Is an Inside-Out Process Cultural proficiency is an inside-out process of personal and organizational change. It is who we are more than what we do. We are students of our assumptions about self, others and the context in wh ich we work with others Fundamental to addressing educational gap issues is one’s willingness and ability to examine yourself and your organization. Cultural proficiency provides leaders with a comprehensive, systemic structure to identify, examine and discuss educational issues in our schools. Cultural Proficiency Represents a Leadership Paradigm Cultural proficiency . . . a mindset for how we interact with all people regardless of background . . . a worldview that carries explicit values, language and standards for effective personal interactions and professional practices . . . is a 24/7 approach to both our personal and professional lives . . . is not a set of independent strategies one learns to use with others. Educators who commit to culturally proficient practices represent a paradigmatic shift away from the status quo dominant group view. The paradigmatic shift moves from tolerating diversity to transformational commitment to equity. Cultural Proficiency as an Educ ational Leadership Lens The following four tools of cultural proficiency can be used as a template for a leader’s personal and professional development: 1. (HP). In their brief conversation, the co-founders son informed Fiorina that he and his family would publicly oppose the planned merger between Hewlett-Packard and Compaq. In addition, Hewlett told Fiorina that he would be issuing a news release within the hour to announce their decision. Then, just hours later, David Packard Jr., the oldest son of the other Hewlett-Packard co-founder, issued a statement announcing that he would also vote against the merger. (Hoopes, 2003) Suddenly, the future of HP-the company that created Silicon Valley-seemed to rest in the hands of heirs who had never wanted an active role in their fathers company. (Williams McWilliams, Family Affair: HP Deals Fate Rests with Skeptical Heirs, 2001) Had Fiorina failed to effectively sell the deal to Hewlett and Packard family members before making it public? Had she underestimated the power and influence these family members might have in determining the future of the company? (Hoopes, 2003) Despite the cold reception of the deal by many investors and analysts, once approved by the boards at both HP and Compaq, the merger could be stopped from going through in only a handful of ways. The deal could be terminated if the companies mutually agreed to cancel it, if either company experienced a material adverse change, or if regulators rejected it. In addition, either company could decide to break up the deal; however, it would have to pay the other company a $675 million termination fee to do so. Finally, and perhaps most importantly, as a stock transaction, the deal could be terminated if shareholders of either company rejected it. (Williams, Hewletts Reject Deal to Join HP, Compaq, 2001) On September 3, 2001, Walter Hewlett voted with the rest of HPs board to O. K. the proposed merger. However, in the months leading up to the boards vote, Hewlett had expressed concern about the deal and its impact on his familys charities. But just days before the vote, he learned that the merger agreement called for unanimous board approval in order to ensure the best possible shareholder reception. Believing that the board would find a way to approve the merger regardless of how he voted, Hewlett reluctantly cast his final vote in favor of the deal. (Hoopes, 2003) 4 CONCLUSION: Ask Carly Fiorina Although the merger met with poor reception from Wall Street and industry analysts, Fiorina did not back down. She argued that the merger would eliminate one player in an oversupplied PC marketplace. Fiorina often spoke out of context for true economic theory, she needed guidance, yet skirted topics key to point such as integration and merger activities and vertical integration versus horizontal integration. On the other hand, a horizontal merger, by its very definition, reduces the number of firms that compete in the product market place, so maybe she was right. The merger would also eventually improve HPs market share across the hardware line and double the size of HPs service unit-both essential steps in being able to compete with industry-giant IBM. In addition, Fiorina argued, the merger would create a full-service technology firm capable of doing everything from selling PCs and printers to setting up complex networks. The merger would eliminate redundant product groups and costs in marketing, advertising, and shipping, while at the same time preserving much of the two companies revenues. (Hoopes, 2003) To critics who questioned HPs motives for the deal, Fiorina emphasized that the chief driver for the HP-Compaq merger was competitive positioning. To those who questioned the chances that the merger would succeed, Fiorina pointed out that the distinguishing characteristic of successful mergers is the focus on consolidation, not diversification-exactly what HP planned to do after its merger with Compaq. (Hoopes, 2003) To Fiorinas defense, IBM sold its PC division to Chinese manufacturer Lenovo. The company did eventually do everything that she set out to do, only not under her leadership. I believe that she had the vision statement down; it was the mission statement that needed some work. She did not fail in providing vision; she simply did not succeed in her execution of the mission. HP provided pink slips to thousands of former Compaq, DEC, HP, and Tandem employees, and its stock price generally declined and profits did not perk up. Though the merger initially helped HP make it to the top as the number one PC maker, it soon lost the lead along with further market share to Dell. In addition, the merging of stagnant Compaq with HPs lucrative printing and imaging division was criticized as that overshadowed the latters profitability. In February 2005, the Board of Directors ousted Fiorina. Former Compaq CEO, Capellas, was mentioned by some as a potential successor, but several months afterwards, Mark Hurd was hired as CEO. (Flyer, 2008) In late 2005, HPQ seemed to find its feet under the new leadership of Mark Hurd. At this same time, Dell seemed to be faltering and HPQ took back the number one sales position. Hurd separated the PC division from the imaging and printing division. HPs PC segment has since been reinvigorated and now generates more revenue than the traditionally more profitable printers. (Wikpedia, Compaq, 2009) Most Compaq products have been re-branded with the HP nameplate, such as the companys market leading ProLiant server line, while the Compaq brand remains on only some consumer-orientated products, notably Compaq Presario PCs. HPs business computers line was discontinued in favor of the Compaq Evo line, which was rebranded HP Compaq. HPs Jornada PDAs were replaced by Compaq iPAQ PDAs, which were renamed HP iPAQ. In 2008, HP dropped the Compaq name from its HP Compaq business notebooks and is now marketing them as the HP EliteBook and as of early 2009, the HP ProBook, leaving the Compaq name for HPs entry-level consumer platforms. This trend has been going in recent years for several pharmaceutical companies in the US. This year alone, thirteen tax-inversion deals have been completed, with US drug companies buying foreign counterparts in order to relocate their tax bases abroad (Lorenzetti 2014). Pfizer has made this particular motivation public when it made its bid for AstraZeneca. The corporate tax in the UK is 21% and is expected to fall to 20% in 2015 whereas the US charges corporations 35% (Farell 2014). The UK government was dragged into the issue because the takeover became a matter of public interest, requiring intervention. In terms of crowd size, there were probably 200-300 people in attendance. The collection of these people increased in attendance from the beginning of the show and by the end of the show the numbers were around the 300 mark. Most of the people in attendance were the same age from their 20s to early 30s; however there were a handful of people in their late 30s that were in attendance. Many different ethnic groups were in att endance, although the main ethnic group in the audience was white Caucasians. The stage for the performance was not decorated for any of the bands that performed. However, there was lighting that occurred for each of the bands. When the final band came on stage, the lighting was coordinated with specific aspects of their performance such that the audience could see these different aspects during specific parts of songs. While the audience did not entirely sell-out, it was close to selling-out towards the end of the concert and there was virtually no room left for people to stand in the auditorium. The acoustics in the concert area depended largely on the band that was performing. In all instances, the sound was loud. The SEC requires public companies to disclose significant and meaningful financial information to the public in order to guarantee security within the U.S. Federal prosecutors and the securities regulators filed charges against the Chief Investment Office (CIO) consisting of two JP Morgan Chase traders for the massive trade losses totaling $5.8 billion. The employees were charged with conspiracy, wire fraud, falsifying financial records and making false filings with the Securities and Exchange Commission. The Securities and Exchange Commission simultaneously filed a corresponding civil complaint in which the agency signaled it would hold the bank accountable for disclosing inaccurate information to investors about the trading. Elements of Valid Contract – Good Faith and Fair Dealing in Banking Relationships Chapter 7 of The Legal Environment describes the element of what is contained in a valid contract. â€Å"Every contract contains and implied covenant of good faith and fair dealing in its performance that imposes on each party a duty not to do anything that will deprive the other party of the benefits of the agreement. Intentional and Negligent Tort Actions An intentional tort transpires when an individual intentionally causes damage or injury to another person their property. Some examples are abuse, kidnapping or assault. A negligent tort transpires when an individual causes damage or injure to another without the intent to do so. An example of this would be a car accident or if someone accidentally slips, falls and becomes injured. Interference with Contractual Relations, Participating in Breach of Fiduciary Duty – The tort of interference with contractual relations protects the rights of a legally binding contract and requires the intent to interfere if such agreement has been breached. In the case of JP Morgan Chase I would be able to succeed based on the fact that the act of intentional tort action was carried out. Protection of Online Banking In today’s world of online banking, the technology is simply an amazing necessity. The Education of Non English Speaking Students in the U.S. Growing up in a family where the dominant language spoken was Spanish, I remember feeling lost and separated from the kids at school who spoke mainly English. Even more so was trying to keep up in my academics when it was taught in a language I hardly understood or even worse, could speak. However, because of the close family I had at home, I remember being encouraged to learn the language as best I could because the idea remained that in order to succeed you must be able to effectively communicate in the English language. U.S. FOREIGN POLICY REVIEWED FROM THE RECEIVING END After September 11th 2001, much attention has been given to the developing world and the progressive problems which are present. The precondition to the terror which took place late last year, can be traced back for decades. History portrays dozens of examples of where American covert activities and overt foreign policy has gone against values that the American government so publicly and loudly proclaims. Americans tend not to see this, because they are unconcerned with the rest of the world and tend to uncritically trust their government to do the right thing, believing what they are endlessly told about the promotion of freedom, democracy and human rights. Seldom do they see the behaviour of their government abroad as the rest of the world sees it. That is why America is so hated, even though it's power and privilege is so envied. Americans think it is envy that has stirred such passion. The reality is that it is not. It is resentment and anger at the constant hypocrisy of American governmental foreign policy and behaviour and the total ignorance Americans have of it. In 1948, Israel came into existence completely dependent on the United States, as a result of the many thousands of American Zionists who had moved there. Within a year, a wave of terror swept through the Palestinian villages under Israeli control, reducing their number from 365 to little over a hundred in just a few months. Waves of refugees, nearly a million in all, fled to the Gaza Strip (then under Egyptian control), the West Bank (then under Jordanian control) and into Lebanon and Syria, to temporary refugee camps, where today, a half century later, they continue to live in those same "temporary" refugee camps. This is to say that the third world country has invested a lot of time and resources in dealing with such macroeconomic variables such as unemployment, inflation, and population growth rate (Manson & Knight, 2009). Among the poorest people in Sierra Leone are the people rendered landless by the internal armed conflicts. Small-scale farmers and single mothers heading families constitute a great percentage of the poor rural population. People that were internally displaced by the civil war are destitute and own or access no resources. As such, they resort to such desperate measures as begging or working for little pay so as to support their survival. It is estimated that 75% of the people of Sierra Leone live below the poverty line, with 27% living in extreme abject poverty. This was according to a 2005 research, which established that fifty percent of the entire populace lives on slightly less than one US dollar per day. According to the records of the year 2005, 80% of the people living in the rural ar eas lived in extreme poverty. Similarly, the people of the eastern districts were hard hit by the civil strife and lived in extreme poverty (Manson & Knight, 2009).
